Terms of Service
Effective September 23, 2026
These Terms of Service (“Terms”) govern your access to and use of the Eerie Sightings website, iOS application, Android application, and related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, a parent or legal guardian must approve your use. You must provide accurate account information, keep your account secure, and promptly notify us if you believe it has been compromised. You are responsible for activity conducted through your account.
2. The Service
Eerie Sightings provides a map and community platform for exploring and sharing reports about paranormal, unexplained, folkloric, historical, and related events. Reports may come from users, public records, historical collections, folklore sources, or other third parties. Inclusion on the map does not mean that Eerie Sightings has verified or endorses a report.
3. User content
You retain ownership of text and other content you submit (“User Content”). By submitting User Content, you grant Eerie Sightings a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify for formatting or accessibility, publish, display, distribute, and otherwise use that content to operate, improve, promote, and provide the Service. This license continues for as long as the content is available through the Service and for reasonable backup, legal, and archival periods.
You represent that you own or have permission to submit your User Content and that our permitted use will not violate another person’s rights or any law. Anonymous attribution changes what other users see; it does not remove the report’s association with your account from our private systems.
4. Community rules
You may not use the Service to:
- submit information you know is materially false, deceptive, fraudulent, or unlawfully obtained;
- harass, threaten, stalk, exploit, or impersonate another person;
- publish another person’s private information, including a private home location, without authorization;
- infringe copyrights, trademarks, privacy, publicity, or other rights;
- post unlawful, hateful, sexually exploitative, or malicious content;
- upload malware, probe security, interfere with operation, scrape at unreasonable volume, or evade access controls;
- use the Service to plan trespass, dangerous conduct, or any unlawful activity; or
- misuse reporting, authentication, or account-deletion systems.
We may remove or restrict content, suspend accounts, or preserve and disclose information when we reasonably believe doing so is necessary to enforce these Terms, protect people or the Service, or comply with law. We are not obligated to monitor every report.
5. Safety and informational disclaimer
The Service is for informational and entertainment purposes. It is not an emergency, navigation, medical, scientific, law-enforcement, or public-safety service. Map locations may be inaccurate, outdated, unsafe, restricted, or located on private property. Do not trespass, enter hazardous areas, approach wildlife, interfere with investigations, or place yourself or others at risk. In an emergency, contact the appropriate local emergency service.
6. Imported and third-party material
The Service may summarize or link to government records, public-domain material, folklore, news, archives, maps, or third-party websites. Source labels and links are provided for context and do not guarantee accuracy, completeness, current availability, or legal status. Third-party services are governed by their own terms, and we are not responsible for their content or practices.
7. Eerie Sightings intellectual property
Except for User Content and third-party material, the Service—including its software, design, branding, logos, and original content—is owned by or licensed to Eerie Sightings and protected by applicable intellectual-property laws. These Terms give you a limited, revocable, non-exclusive, non-transferable right to use the Service for its intended personal purposes. No other rights are granted.
8. Copyright concerns
If you believe material on the Service infringes your copyright or other rights, email [email protected] with identification of the work, the disputed material and its location, your contact information, and a statement explaining your claim. We may request additional information needed to evaluate it.
9. Changes, availability, and termination
We may add, change, suspend, or discontinue any portion of the Service. We may suspend or terminate access when we reasonably believe you violated these Terms, created risk or legal exposure, or misused the Service. You may stop using the Service at any time and may delete your account through the Account screen. Provisions that by their nature should survive termination will survive, including licenses already granted, disclaimers, limitations of liability, and dispute provisions.
10. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” EERIE SIGHTINGS DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND THAT THE SERVICE WILL BE SECURE OR ERROR-FREE. WE DO NOT WARRANT THE TRUTH OR RELIABILITY OF ANY SIGHTING, USER CONTENT, SOURCE, OR MAP LOCATION.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EERIE SIGHTINGS AND ITS OWNERS, OPERATORS, AFFILIATES, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR OPPORTUNITIES, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID US TO USE THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not permit certain exclusions, so some of these limitations may not apply to you.
12. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Eerie Sightings and its owners, operators, affiliates, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from your User Content, your misuse of the Service, or your violation of these Terms or another person’s rights.
13. Disputes and applicable law
These Terms are governed by applicable law, without regard to conflict-of-law rules. Before filing a claim, you and Eerie Sightings agree to make a good-faith effort to resolve the dispute informally by written notice and at least 30 days for a response. Nothing in these Terms prevents either party from seeking urgent injunctive relief or using a small-claims process where eligible. Any rights you have under mandatory consumer law remain unaffected.
14. General terms
If a provision of these Terms is unenforceable, it will be modified only to the extent necessary and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization, financing, merger, acquisition, or sale of assets. These Terms and the Privacy Policy constitute the agreement between you and Eerie Sightings concerning the Service.
15. Changes and contact
We may update these Terms by posting a revised version and changing the effective date. Continued use after the effective date means you accept the revised Terms. Questions about these Terms may be sent to [email protected].
